4.7 What shall I do when filing a PDX request with TIPO if I have filed a patent application with the patent office that partners with TIPO on PDX and subsequently file a patent application in Taiwan for the same creation?

An applicant may indicate the country name, filing date, application number, access code and patent type of the first filed patent application while filing a subsequent patent application for invention or utility model in Taiwan or submit the above information within 16 months after the claimed earliest priority date. If such a submission is made, the paper priority document is deemed unnecessary.

Different patent offices may require different PDX information. For instance, JPO requires information on access code and patent type, whereas KIPO does not. Therefore, it is important for an applicant filing a PDX request to pay attention to such differences.
