5.1 Should I search for prior art before applying for a patent?

Although a search for prior art before filing an application is not required, it is advisable to do so. A search of all previous public disclosures (prior art), including, but not limited to, previously patented creations in the ROC, should be conducted to determine if your creation has been publicly disclosed and thus is not patentable. A search of foreign patents and printed publications should also be conducted. Conducting a thorough patent search is difficult, particularly for the novice. Patent searching is a learned skill. A registered patent attorney or agent or relevant professional is often a useful resource for conducting a patentability search. One way of checking whether or not your product or idea has already been created and patented by somebody else is to consult those free patent search websites provided by TIPO and other foreign patent offices. https://twpat1.tipo.gov.tw/twpatc/twpatengkm
