6.7 How to speed up examination?

There are three programs to speed up examination: Accelerated Examination Program (AEP), Patent Prosecution Highway (PPH) Program, and TW-Support Using the PPH Agreement (TW-SUPA) Examination Program.

(1) Starting January 1, 2010, TIPO began accepting requests for the Accelerated Examination Program (AEP). The applicant whose invention application has or has not undergone substantive examination or re‐examination is eligible to request AEP. Relevant documents have to be provided. (2) The PPH Program is a framework under which an application whose claims have been determined to be patentable in the Office of First Filing (OFF) or Office of Earlier Examination (OEE), is eligible to go through an accelerated examination in the Office(s) of Second Filing (OSF) or Office of Later Examination (OLE), upon the applicant’s request. Generally, PPH comes in Normal PPH and PPH MOTTAINAI. TIPO signed the PPH Agreements with USPTO, JPO, SPTO, KIPO, PPO and CUPO. (3) TIPO launched the TW-Support Using the PPH Agreement (TW-SUPA) Examination Program on March 1, 2012. Under this program, TIPO is the OFF (Office of First Filing) of an invention patent application. The applicant may request advanced examination for the corresponding application subsequently filed at the Office of Second Filing (OSF), which has a PPH or PPH MOTTAINAI agreement with TIPO.
