6.13 With which IP offices has TIPO signed an MOU on the deposit of biological materials for the purposes of patent procedure? And what are these offices’ designated depositories?

TIPO has so far signed an MOU agreement on the deposit of biological materials for the purposes of patent procedure separately with the Japan Patent Office(JPO) and the United Kingdom Intellectual Property Office(UKIPO).

The MOU between TIPO and JPO entered into force on June 18, 2015.

The MOU between TIPO and UKIPO entered into force on December 1, 2017.

The MOU between TIPO and KIPO entered into force on September 1, 2020.

Through the implementation of these cooperative programs, Taiwanese applicants wishing to file patent applications involving biological materials with a foreign country or any foreigners wishing to file patent applications involving biological materials with TIPO are able to deposit their biological materials in nearby designated depositories. This will reduce the burden of applicants having to repeat the process of making a deposit.

TIPO’s designated depository institution is the Food Industry Research and Development Institute (FIRDI)

JPO’s designated depository institutions are the International Patent Organism Depositary, NITE (NITE-IPOD) and NITE Patent Microorganisms Depositary (NPMD).

UKIPO’s designated depository institutions should follow relevant laws and regulations of the UK and meet the following requirements:

(1) receiving, accepting and storing biological material and the furnishing of samples of such biological material, whether generally or of a specific type;and

(2) performing the abovementioned functions objectively and impartially.

KIPO’s designated depository institutions are the Korean Collection for Type Cultures (KCTC)、Korean Culture Center of Microorganisms (KCCM)、Korean Cell Line Research Foundation (KCLRF) and Korean Agricultural Culture Collection (KACC).
