8.4.3 Is it necessary for the agent or distributor of the goods bearing a registered trademark to apply for recordation of the license?

An agent or distributor only sells or distributes goods on behalf of a trademark right holder, rather than using the registered trademark concerned to identify the source of his/her own goods, so it is not necessary to record the license. However, where promotion and advertisements are launched for a foreign trademark that is not familiar to the domestic audience but is intended to be used on goods to be marketed in the domestic market, the right to use that trademark may be obtained through license or assignment after an agreement has been concluded with the original trademark right holder.
