8.6.1. What steps need to be taken if the original registration certificate is damaged or lost?

A registration certificate is given upon the acquisition of the trademark rights. In international practice, there is no need to indicate the change of particulars on a registration certificate. Therefore, the certificate of trademark registration issued in the ROC deletes the column of "contents of change." In view of the need to prove his/her rights, a trademark right holder may request the issuance of a replacement certificate for acquiring the latest information of the trademark rights by submitting the following documents, in addition to certifying documents related to the trademark registration (photocopying trademark registers, a certificate of registration). For those who request the issue of a replacement certificate for reasons other than damage or loss, the original registration certificate shall be returned. Upon the issuance of a replacement certificate, the reference number of the original registration certificate shall be abolished. (§41, Enforcement Rules of the Trademark Act)
