National Invention & Creation Award

The following guidelines are based on the《Regulations Governing Invention and Creation Awards》.

 

Selection Guidelines for the National Invention and Creation Awards:

I. Purpose: To encourage persons researching new creations related to inventions, utility models, or designs, the Taiwanese government selects outstanding inventors and recognizes them with the National Invention and Creation Award. By doing so, we hope to promote a culture of research and innovation and facilitate the development of our nation’s industry and technology.

 

II. Eligibility:

1. Candidates must be an ROC citizen.

2. Entries:

(1) Invention Award: Candidates may submit entries for the Invention Award provided that the patent right to the invention entry has been obtained from the ROC within six (6) years prior (e.g., candidate holds a patent certificate issued for an invention disclosed by ROC from January 1, 2016 to December 31, 2022 and that which remains valid at the time of the application deadline).

(2) Creation Award: Candidates may submit entries for the Creation Award provided that the patent right to the utility model or design entry has been obtained from the ROC within six (6) years prior (e.g., candidate holds a patent certificate issued for an utility model or design disclosed by ROC from January 1, 2016 to December 31, 2022 and that which remains valid at the time of the application deadline).

3. Rules for Entries: Invention, utility model, or design entries may be resubmitted for either the Invention or the Creation Award, provided that it meets the afore-listed requirements. Past winning entries of the Invention or the Creation Award cannot be resubmitted for consideration.

 

III. Award Category & Prize Money:

1. Invention Award

(1) Gold Medal: No more than 6 are awarded every year, and each winning entry receives prize money of NT$400,000, an award certificate, and a trophy. 

(2) Silver Medal: No more than 20 are awarded every year, and each winning entry receives prize money of NT$200,000, an award certificate, and a trophy.

2. Creation Award

(1) Gold Medal: No more than 6 are awarded every year, and each winning entry receives prize money of NT$200,000, an award certificate, and a trophy. 

(2) Silver Medal: No more than 12 are awarded every year, and each winning entry receives prize money of NT$100,000, an award certificate, and a trophy.

3. In the event that no entry qualifies for the Award, the awards may be omitted. The qualifications referred to in the preceding paragraph shall be made by the resolution of the Evaluation Committee.

4. Rules for Award Distribution:

(1) The award given shall be to the inventor/utility model creator/designer whose name appears on the patent certificate.

(2) Where the invention or creation of utility model or design is produced by more than one person, the award shall be presented to all inventors/utility model creators/designers, unless otherwise provided for in an agreement. In such case, the provisions set out in the agreement shall prevail. The recipients shall negotiate on how the award should be distributed among them within a specified period of time. Should the group fail to reach an agreement within the specified time period, the Taiwan Intellectual Property Office (herein as “TIPO”) may distribute the award equally among all recipients.

(3) Inventors, utility model creators or designers may each be awarded a certificate; the trophy is awarded to all recipients as a whole. Recipients wishing to have a trophy of their own may request a replica from TIPO, provided all the costs are borne by the requesting party.

(4) In the event that the patent right for the entry has been revoked, or where certificates or documents of proof are found to have been plagiarized or falsified, TIPO reserves the right to revoke the award. The recipient must then forfeit and return all awards and subsidies received.

 

IV. Registration:

1. Period: From April 11, 2022 (Mon) to 5:00 p.m. on July 28, 2022 (Thu).

2. Method: To preserve a sustainable ecosystem and conserve paper, only the “Application Form” and the “Affidavit of Renouncement of Candidacy” requires a signed paper copy, which should be enclosed in an envelope bearing the “Application Form Envelope Cover” and mailed via letter-post by Chunghwa Post Co., Ltd. to “11F., No. 149, Sec. 3, Xinyi Rd., Da’ an Dist., Taipei City.” All other documents for the application should be digitalized, and the link to the cloud folder should be emailed to the dedicated mailbox for the National Invention and Creation Awards: [email protected]. The subject of the email should read “2022 National Invention and Creation Award – (Insert Patent Number Here)” and the body of the email should contain contact information.

3. Required Documents and Information

(1) Required documents:

A. Invention Award – Invention Patent: The applicant(s) must fill in the Application Form and Appendix I. The Application Form must be signed by all inventor(s) in full, and IDs from all applicant(s)/inventor(s) must be provided. In addition, the patent certificate and patent specification (including the specification, scope of application, and drawings) of the entry must be attached.

B. Creation Award – Utility Model Patent: The applicant(s) must fill in the Application Form and Appendix II. The Application Form must be signed by all inventor(s) in full, and IDs from all applicant(s)/inventor(s) must be provided. In addition, the patent certificate, patent specification (including the specification, scope of application, and drawings), and the Technical Evaluation Report for Utility Model Patents of the entry must be attached.

C. Creation Award – Design Patent: The applicant(s) must fill in the Application Form and Appendix III. The Application Form must be signed by all designer(s) in full, and IDs from all applicant(s)/designer(s) must be provided. In addition, the patent certificate and patent specification (including the specification and drawings) of the entry must be attached.

(2) Affidavit of Renouncement of Candidacy: If more than two persons apply for candidacy, the names of all inventors (creators or designers) should be signed jointly. If some inventors would like to give up their candidacy, an Affidavit of Renouncement of Candidacy should be attached.

(3) Supplementary Documents or Information: In the event that documents or information submitted by the candidate fails to meet requirements, a list of candidates and requisite supplementary materials will be posted on the official TIPO website under the section for National Invention and Creation Awards [www.tipo.gov.tw (Homepage >> Topics >> National Invention & Creation Awards)] on August 3, 2022 (Wed). No other notices will be given. Candidates should check the site and provide all necessary documents by 5 pm on August 10, 2022 (Wed): paper copies of supplementary materials should be postmarked; cloud links to electronic copies should be mailed to the dedicated mailbox for the National Invention and Creation Award: [email protected], and the subject of the email should read “Supplement – 2022 National Invention and Creation Award – (Insert Patent Number Here )”. Applicants who fail to submit supplementary materials by the deadline or who still fail to meet requirements after supplementary materials are submitted will not be considered for the award.

(4) Please note:

A. If the inventor (creator or designer) has passed away, he or she shall be represented by his or her successor. The successor should provide an ID and other relevant information, and sign his or her name within the "Candidate Signature" column. If the inventor or creator has undergone a change of name, he or she should submit a document issued by the relevant household registration agency certifying the change of name.

B. One application form is limited to one patent entry.

C. Patent specifications and the Technical Evaluation Report for Utility Model Patents can be obtained from the Taiwan Patent Search System [https://twpat1.tipo.gov.tw/twpatc/twpatengkm]

D. The aforementioned registration materials will not be returned once submitted.

 

V. Evaluation:

1. The Invention and Creation Evaluation Committee

(1) TIPO shall set up an Invention and Creation Evaluation Committee (“the Committee”) and appoint 25 to 40 members consisting of scholars, specialists, and representatives from the relevant competent authorities. The Committee shall be in charge of all matters related to the awards.

(2) TIPO shall appoint one individual to serve as the Chair of the Committee. The Committee may be further subdivided into smaller sub-committees to handle different categories of the Award.

2. The Evaluation Process

(1) Preliminary Round: The Committee shall select a list of preliminary winning entries after all the application documents have been reviewed.

(2) Semifinal Round: According to the list of preliminary winning entries, the Committee may deem it necessary to conduct an on-site evaluation in groups or request presentations from candidates to explain the entries before giving a score.

(3) Final round: The Committee shall select the final award recipients based on the total scores of the preliminary scores for thirty percent (30) and the semifinal scores for seventy percent (70).

3. Evaluation Guidelines:

(1) Invention Award

A. Technological Research and Development 40%

Evaluation is based on the degree of technological innovation, differentiation from existing technology, uniqueness, criticality, whether the technology can be implemented, etc.

B. Patent Value 40%

Evaluation is based on production or implementation costs, patent usage, the extent which the patent applies to the product, contribution to the industry, positioning strategy, etc.

C. Commercialization and Marketability 20%

Evaluation is based on technology transfers, licensing, industry-academia collaboration, commercialization value or potential, etc.

(2) Creation Award

A. Utility Model Patent

a. Technological Research and Development 35%

Evaluation is based on the degree of technological innovation, differentiation from existing technology and products, uniqueness, criticality, whether the technology can be implemented, etc.

b. Patent Value 30%

Evaluation is based on production or implementation costs, patent usage, the extent which the patent applies to the product, positioning strategy, etc.

c. Technical Evaluation Report 5%

Evaluation is based on the results of a comparison with claims listed in the Technical Evaluation Report.

d. Commercialization and Marketability 30%

Evaluation is based on technology transfers, licensing, industry-academia collaboration, commercialization value or potential, etc.

B. Design Patent

a. Visuals and Design 40%

Evaluation is based on innovation of craftsmanship, visual effect and design creativity of the product, etc.

b. Patent Value 30%

Evaluation is based on production or implementation costs, the extent which the patent applies to the product, positioning strategy, etc.

c. Commercialization and Marketability 30%

Evaluation is based on technology transfers, licensing, industry-academia collaboration, commercialization value or potential, etc.

※The evaluation guidelines are for reference only. The Committee shall have the final say in the actual evaluation outcome.

4. Incentives for Innovative Research by Individual Inventors

(1) All entries (inventions applying for the Invention Award or utility models and designs applying for the Creation Award) of which the inventors, utility model creators, or designers are also the patentees, the Committee may consider giving extra points in the semifinal round.

(2) The number of extra points awarded shall be decided by the Committee.

5. Notification of Evaluation Results

The results of the preliminary, semifinal, and final round of evaluation, as well as a list of winning entries, shall be posted on the official TIPO website under the section for National Invention and Creation Awards [www.tipo.gov.tw (Homepage >> Topics >> National Invention & Creation Awards)].

6. Requesting a Review

(1) Candidates may submit a request for review within thirty (30) days after the evaluation results have been announced by TIPO, after which no requests for reviews will be accepted.

A. The candidate shall submit a form to TIPO requesting a review, which shall include the name of the entry (inventions, creations of utility model or design) and relevant contact information.

B. Only one review may be performed.

(2) The request for a review is not a request for reexamination. Also, the candidate may not request personal information about any committee members, including their names.

 

VI. Recognition

1. Award-winning entries shall be recognized by TIPO with a public award ceremony. TIPO will also compile a bilingual (Chinese and English) album featuring award-winners and promote it to the public via digital, platform, and online media. Award-winners should provide TIPO with digital files of all relevant photos and both the English and Chinese content to be featured in the album.

2. Award-winners should attend the 2023 Taiwan Innotech Expo (expected date: October 2023), and TIPO will fully subsidize the booth fees for exhibiting. Award-winners should also participate in promotional events such as award-winning entry exhibits and the award ceremony (expected date: April 2023.
