What can I do if I failed to claim priority or provided incomplete priority information when filing a patent application?

Font Size:

Where an applicant unintentionally fails to claim priority at the time of filing, or where the priority claim is deemed not to have been made because the filing date of the first patent application or the name of the country (or WTO member) was not specified, the applicant may, within 16 months after the earliest priority date (or 10 months in the case of a design application), apply for reinstatement of the priority claim, pay the required fee (NT$2,000), and complete the required actions.

Please note that to apply for reinstatement of a priority claim, the applicant must have filed the patent application with TIPO within 12 months (or 6 months in the case of a design application) from the filing date of the first patent application.
