2025 Taiwan-Japan Intellectual Property Seminar Concludes Successfully

The 2025 Taiwan-Japan Intellectual Property Seminar was successfully held on the afternoon of September 5, 2025, at Tsai Lecture Hall, College of Law, National Taiwan University. Centered on the theme "Legal Frameworks and Practices of Patent Infringement Litigation in Taiwan and Japan," the event featured distinguished speakers from both government and industry. These included Mr. Hayato Ikoma, Director of the International Affai rs Division, JPO General Affairs Department; Ms. Tzu Kuan Wei, TIPO Section Chi ef; Mr. Tomonori Okuwaki, Vice President of the Japan Intellectual Property Association and Head of the Intellectual Property Department at Chugai Pharmaceuticals; and Mr. Peng Fei Lin, Manager at Foxconn. Together, they shared the latest developments and strategies in patent infringement litigation from both policy and corporate perspectives.

In the first session, Mr. Ikoma provided an overview of Japan's patent litigation system, highlighting key procedural features and comparing them with the Taiwanese framework. He also discus sed JPO's ongoing efforts to adapt its IP system in response to digital transformation. Ms. Tzu Kuan Wei then introduced Taiwan's current legal landscape and practices regarding patent infringement, covering topics such as patent certificate number marking , joint infringement, and patent linkage litigation, as well as the impact of the 2023 amendments to the Intellectual Property Case Adjudication Act.

In the second session, Mr. Okuwaki offered an in depth analysis of patent litigation practices in Japan, including trends in damage compensation, the challenges faced by companies, and key rulings delivered in 2025. Finally, Mr. Lin presented empirical research on the societal and corporate innovation impacts of patent litigation, with a special focus on Non Practicing Entity (NPE) behavior and the litigation risks they pose to high tech industries. He also proposed risk mitigation strategies such as patent insurance, portfolio development, and defensive measures like the LOT Network. The seminar attracted over 160 participants from industry, government, and academia. The lively discussions and active exchange of insights between experts from both countries deepened mutual understanding of the respective legal systems and practices. The event also provided valuable reference for Taiwan Japan collaboration on patent strategy and risk management.
